2. Scope

This policy describes how Numeriq AG processes personal data in connection with:

  • The website www.numeriqpayroll.ch ("Website")
  • The payroll platform app.numeriq.ch ("Platform")
  • Employment and service relationships with consultants, employees, and clients

3. Data We Collect

Consultants and employees (via the Platform):

  • Personal details: name, date of birth, gender, nationality, contact information, address
  • Identity documents: passport/ID copies, work permits
  • Employment data: contract details, timesheets, expenses, activity reports
  • Payroll data: salary, bank account (IBAN, SWIFT), AHV/AVS number
  • Social insurance: AHV/IV/EO, BVG/LPP, UVG, IJM, child allowance details
  • Tax data: tax-at-source canton, scale, withholding amounts
  • Family data (where required by law): marital status, spouse and children details for social insurance and tax purposes
  • Health data (limited): sickness certificates, accident reports, maternity records — processed only where required by UVG, KTG, or employment law

Clients: company details, contact persons, billing and contract information.

Website visitors: data collected via cookies and analytics (see Section 7).

4. Why We Process Data

We process personal data for the following purposes:

  • Performance of the employment contract (Art. 328b CO)
  • Salary calculation, payment, and payslip generation
  • Social insurance administration (AHV, BVG, UVG, IJM, child allowances) — as required by AHVG, BVG, UVG, and related legislation
  • Tax-at-source withholding — as required by DBG and cantonal tax laws
  • Invoicing clients and managing service relationships
  • Regulatory compliance (SECO reporting, cantonal employee announcements, work permits)
  • Platform operation, security, and technical support
  • Website analytics (with consent — see Section 7)

Health data is processed exclusively where required by law (accident insurance, sickness benefits, maternity). It is subject to restricted access within Numeriq.

5. Data Sharing

We share personal data only to the extent necessary:

Service providers: We use processors who act on our instructions under data processing agreements. These include cloud hosting, payroll software, and IT services providers. Our processors are contractually required to protect data and may not use it for their own purposes.

Authorities: We disclose data to Swiss social insurance institutions, tax authorities, cantonal labour offices, and SECO as required by law.

Client companies: For consultants placed at client sites, we share the data necessary for the work assignment (name, contact details, qualifications, work schedule).

We do not sell personal data.

6. Data Location

Where service providers are involved in processing personal data, we require that adequate safeguards are in place in accordance with the Swiss Federal Act on Data Protection (nFADP).

7. Cookies and Analytics

The Website uses cookies. Strictly necessary cookies (session management, security) do not require consent. Analytics cookies are activated only with your consent through the cookie settings on the Website. You can change your preferences at any time via the cookie settings link in the footer, or by adjusting your browser settings.

8. Retention

We retain personal data as long as necessary for the stated purposes or as required by law. Key retention periods:

  • Payroll records, Lohnausweis, social insurance records, tax records, employment contracts: 10 years from end of financial year (Art. 958f CO)
  • General HR files: 5 years after end of engagement (Art. 128 CO)
  • Website analytics: 26 months

Due to these legal retention obligations, most payroll and employment data cannot be deleted until the applicable retention period has expired, even upon request.

9. Your Rights

Under the Swiss nFADP, you have the right to:

  • Access your personal data (we respond within 30 days, free of charge)
  • Rectify inaccurate data
  • Request deletion of data not subject to legal retention obligations
  • Request data portability in a commonly used electronic format
  • Object to processing based on overriding interests

If you believe your rights have been violated, you may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, CH-3003 Bern (www.edoeb.admin.ch).

10. Security

We implement appropriate technical and organisational measures to protect personal data. If you discover a security vulnerability, contact security@numeriq.ch.

11. Changes

We may update this policy. Material changes will be communicated via the Platform or by email. The effective date above indicates the current version.
